Not really, if the schools win the lawsuit, the proceeds would come from schools whose properties weren't assessed over 11%. Thus all other schools would be on the hook for 300 million. That would be catastrophic to all of them. I agree the effected schools should be compensated, but there is no money in the receiving schools budgets to take this hit.

Instead, those dollars were "diverted" to other school districts where taxpayers paid a lower tax rate.
That "diverted" means the rest of them got more than they were supposed to. In order to make this correct, the only place the proceeds can come from is the schools that were overpaid. I don't have a clue how much that would cost us, but if it were any at all it would cripple us at this time as well as everyone else.

I must read things totally different than you do. Not the way I see it at all. You misread things. If they win the lawsuit, the money comes out of the coffers of the other districts because basically, they were overpaid. Really bad time for this lawsuit. Luckily, we won't see a resolution to this for possibly YEARS.

I see.
So my next question is, who is responsible for dropping the ball on this? How does this even happen??

How do they not notice this for 20+ years? Sounds to me like it's the same problems the voters in this state have as well. No one knows jack shat and they just sign the sheet and move on!!

The Department of Education knew about this before our current financial crisis and chose to do nothing about it... So poor timing now, yes. But at the same time you can't fault the underpaid districts for wanting their money when they need it the most.

Pretty sure when the state finally admitted this a few years ago, that they said they would not take money back from the schools that received it. I figured there will be a settlement for half .

You are probably right. However, if they were to pay the back assessments from future revenue to the state department, that would amount to that much less going into the formula. If the affected schools win, everyone will pay directly or indirectly.
